stay order on the divorce petition

24-Aug-2023 (In Divorce Law)
Hi, this is on the behalf of my brother. We have filed a divorce petition, my brothers wife got a stay order on this requesting that she want to transfer the case to her place. She is staying at her mothers place now. We want to close this as early as possible. She has not attended for any of the hearings happened so far in my brothers place. How can we go ahead here. Can we file one sided divorce. ?

Dear Sir, The Indian Marriage Laws are in favour of married women and thus her transfer petition may be allowed. You should not object for such transfer instead ask your brother to execute Power of Attorney in favour of any of his relative who will attend the case. You may go to High Court for getting a direction to the Family Court to dispose of the same within a maximum period of 12 months.
