In case the 498A/dowry accusations are proved false in Court, one may produce additional evidence (if any) to support their claims. Otherwise, an appeal to a higher Court may always be preferred. Further and better particulars are needed for an effective opinion.

Query perused. Wife can still claim maintenance by filing a Section 125 Crpc petition. She is entitled to file for divorce as well on the grounds mentioned in Section 13 of the Hindu Marriage Act. For further consultancy and legal services you may contact us
