Yes legal separation is compulsory though she was a minor but she had legally married someone so now when she wants to get separated then she has to approach court and get divorced mutually if she wants to marry again

What is her age now? She already married (irrespective of her age) as per customs. He need to apply for divorce. If both wife and husband agree for the same they can apply for mutual divorce. Since how many months she is staying separately.

Hello, she can get divorce. But what is her age now. When she got married and why was she is living separately. Was she is having children, is the marriage was consummated or not. If possible try to get divorce by way of mutual consent and before that try to resolve the issue if any chance is there, because they dont know anything as they are youngsters, dont know anything about life, try to reconcile them.

Dear,

Your sister needs to obtain divorce from her husband through the family court of jurisdiction. Though your sister is living separately from her husband, she needs to file a divorce petition for ending the marriage. However, if there is a possibility of mutual consent divorce, ask your sister to go for that or else your sister may need to file contested divorce petition and proceed further.
