Should my mom file for Divorce or not

12-Jan-2023 (In Divorce Law)
My parents have been married for 37 years. Father has always been extremely temperamental and quarrelsome person who liked dominating everyone. He tortured and harassed us for years, both physically n mentally. I got married in 2014 n started living with my husband.Father got retired in august 2022. After that, he made my mom’s n sister’s life hell. So my mom n sister left the house and started living separately since august 2022. nBut he is not letting us live in peace. He comes with relatives to their house and creates scene. He lodged a NC in police station that my mother beat him up. The police ofcourse closed the NC. N now he is saying that he is going to court coz the police did nothing on his NC and that he has a threat to life from us.My mother is an old woman, she is an anxiety-depression patient. My sister is earning n running the house, bearing all expenses. My father has clearly stated that he would not bequeath any of his money or property to us. What to do.

Hello, this is a case of break down of marriage between your parents. As per your explanation it seems that your father is causing great mental and physical cruelty and not paying single penny to your mother and sister for which they can file maintenance petition under Sec 125 of CrPC and mother can also file divorce petition in family court
