Should I divorce my wife after all she has done to me...

24-Jun-2023 (In Divorce Law)
My wife who is a Bipolar Disorder patient left me with my two kids to her brothers place. She joined a nearby school as a teacher. We are not on talking terms since Dec 2018, but sometimes I talk to my kids. I tried to reconcile, but was beaten up and sent back. Since she knows about my company's boss, so she often calls him. Recently, my boss called and asked me whether he should transfer my last month's salary to my wife's account. I said NO. After a few days, he told me to write an affidavit for taking loan. I gave the unfilled softcopy of it. Two days back I talked to my kids and came to know that my wife had bought a luxury smartphone with tripod. My boss transferred money to her account without my knowing it. I know nobody from her or my family had given her money. If she is unable to payback the amount, will it be recovered from me ? What should I do ? I am thinking to divorce her and apply for the custody of my kids. Please help.

Yes, you can very well do that. But, it depends that whether it will be a mutual divorce of a contended one. If you are filing a contested divorce, then miscellaneous things such as a maintenance and custody will be decided in a separate application filed for the custody under hindu minority and guardianship act. However, there are certain grounds essential while filing a contested divorce that has to be seen while ascertaining the facts in your case. Other is a mutual divorce, for which you have to send a notice for divorce by mutual consent. In this there will be a mutually decided petition which will be based in the pre determined alimony and maintenance and custody of the children. All that can be done after considering the facts of the case. So, my answer to your query is answered in affirmative.

I have perused the contents of your query and would advise you to seek a detailed consultancy from a lawyer having expertise in matrimonial cases. You can seek divorce on the ground of cruelty. Better particulars are required.

Since you have not disclosed your religion then I will presume you as Hindu and will advice accordingly. You can divorce your wife on these grounds as she is not living with you without any genuine reason. Your boss can not transfer your salary to your wife's account without your consent.(You can file a complaint regarding this) Custody of child depends on many things.(their age , financial status, health etc)
