Settlement in Mediation Divorce and other cases

09-Dec-2023 (In Divorce Law)
Petitioner (husband) and myself (respondent) are willingly agreed to rejoin and will lead normal family life. We had mediation in the family court on Oct 1, 2021 stating that petitioner will quash Divorce and G&WC and respondent will quash 498a and resume marital relationship. On Dec 9, I (respondent) have received the settlement final copy (in jpg) for signature (without a prior draft document ). Below is the statement which is contradictory to what we have agreed in the mediation before the mediator in the family court. para 1: The petitioner filed a divorce case (file #..) under section 13(1)(i-a) of HMA seeking dissolution of his marriage with the respondent Para 2 and sub-para of 2 donot mention anything about the rejoin. It mentions that petitioner has agreed to withdraw G&WC. Also mentioned about quashing 498a case. Para 3.in view of aforesaid agreement...petitioner prays to dismiss the petition as not pressed. Please advice, is this settlement for dissolution of marriage?

Dear Madam, The clauses are not clear so you have not given any option to rejoin your spouse. It is better not to sign such document unless you approach any advocate and get more idea about it. You have to withdraw your cases and it is silent about the reunite as such it may not work out for you to rejoin with your husband. You should not hurry in signing the document.

It is very complicated in this kind of matrimonial issues as there are number of cases pending before the various courts. It very much better to go personally and enquire by taking all certified copies and have a copy with you for your future use if any. We can say it is for reunion as per the above said facts. But, never take a call without paper in your hand.
