Seperation or divorce from husband

Its been almost 4 yrs to my wedding. My husband is frm HP. 3 month back i became mom. 2 days post delivery my MIL misbehaved n put so many allegations on me on cultural differences. She insulted my parents & me. My husband supported his mother. I m in depression since then. Theres no emotional mental connect with my husband now. I want to step out of this marriage with my 3 month old. But i am scared of his mother behaviour, as last tym my parents got very sick after that event. I dnt wana loose my child in all this. Pls suggest me what to do. I m in unhappy marriage. It is taking my mental peace.

my first suggestion would be reevaluate your reasons to be depressed about. from where I see it in four years you just mentioned one incident to bring forth your reason for depression. that's a good reason to not take any drastic step since even unmarried girls or for that matter boys face more rebuke by their parents for one reason or another in their parental house. in case you feel your ordeal being belittled then I would apologize and render my second suggestion which would be strictly legal: so law prescribe that until a child attains 5 years of age ordinarily the custody of the child will be with the mother. so for a three years old child you have almost your custody ascertained. so it would be idle time to seek divorce and if you can make your husband agreeable to a mutual divorce then it would be fast and convenient. else a contested divorce can endure for a while. dear client as per your query since you are facing mental violence you can live separately you can file case of maintenance and get amount for you and your child too then file for divorce what is your jurisdiction place...

u can file many cases against ur husband and mother in law. u can also filed guardianship or custody cases for keeping ur baby. u can claim maintanance for u and ur baby. kindly contact with me for proper legal action.

at first police complaint, (FIR) 498A, Dowry , then you go to your paternal House, with your child, then after one month you file125 CrPC, and 3 & 4 D V act, After all this is settled you file Divorce caes if you want
