You can file a divorces petition in the family court on grounds of desertion and cruelty and in case if you want to file a mutual consent divorce its well and good since the marriage will be dissolved at the earliest.

Dear Madam, Normally, Mutual Divorce cannot be filed within one year of marriage and there must be twelve months gap for separation to file Divorce petition. You may wait for few more months or file a Petition for Annulment of Marriage under Section 12 read with Section 14 of Hindu Marriage Act. Thus, you may get Divorce if Court accepts such pleadings.
