Sending notice thru advocate for mutual divorce better OR talk first?

29-Mar-2026 (In Divorce Law)
Q: Is it advisable to send amicable legal notice if mutual divorce desired or talk inperson first? 5 yrs separation. 7 yrs together. No child. No legal action till now. My daughter unemployed, no house. She paid for her most of basic needs while married, also payed for renovation of husband's parents house. Husband conduct was bad. Earlier he was not interested to give my daughter's money back also. Daughter wants to try mutual first bt husband might not be ready without any legal intimidation.

“Do not start with an aggressive legal notice. First send a soft, lawyer-drafted settlement notice proposing mutual divorce, along with financial settlement and a clear reply deadline. A direct in-person discussion alone is not advisable. If he cooperates, proceed with mutual consent divorce; if he delays or refuses, then initiate appropriate legal action and maintenance/alimony claims.”

Your problem is understood. First tell me how old you are. How old is your daughter. If you live in Gandhinagar or Ahmedabad, you can meet me in person. Or you can call me.( nine nine one three eight five seven four nine eight)

it Is better to amicable relations first if the matter is not sorted out then you can seek for mutual divorce and you may also seek maintenance from your husband and under dv act or under section 125 you can seek maintenance

yes, firstly send legal notice for showing desire for mutual divorce. if he is ready then file mutual divorce. bt if he is not replying or not agree for divorce, file contested divorce. you have right to get divorce.
