Send legal notice for divorce petition

20-Mar-2026 (In Divorce Law)
My wife had filed a false complaint against me of dowry and physical & mental harrassment. Which was dismissed in bharosa cell as she herself admitted that no such thing had happened. In bharosa councelling i somewhere felt wronged as the officer and mahila aayog Adhikari only focused on her one sided manipulated story and ended up saying there's no big issue and you can live together. But on what basis i shall trust this person who filed complaint when I had done nothing. How do I proceed

Issue a legal notice seeking divorce on grounds of mental cruelty due to false dowry allegations. Record her admission before Bharosa Cell. Propose mutual consent or state intent to initiate contested divorce if unresolved.

Since the complaint has already been dismissed in Mahila Cell/Bharosa Cell and your wife has admitted that no such incident took place, it clearly weakens her credibility. You are not legally bound to resume cohabitation merely because counselling suggested so. Trust is a personal choice, not a legal compulsion. If you feel the relationship has broken down, you have the option to proceed with divorce on grounds of cruelty, as filing false complaints itself amounts to mental cruelty.

If you want to give her a divorce you can simply give a legal notice for divorce either mutual consent or through contested if she is not ready for divorce give the papers of Bharosa cell and the complaint of domestic violence ready as you might need it, if she claims alimony or maintenance

Based on Indian law, you have multiple legal remedies to protect yourself and proceed further: File for Divorce: You can seek divorce under the Hindu Marriage Act on grounds of mental cruelty, as false criminal allegations (like dowry harassment) have been established by the Supreme Court of India as a valid ground for cruelty. Initiate Criminal Counter-Action: File a case under Section 211 of the IPC (or Section 248 of the BNS) for making false charges with intent to injure, or file for criminal defamation.
