Seeking Mutual consent divorce , married in 2023 April

Hi Sir/Mam, I am Rajesh and married in April, 2023. After marriage me and my wife things that our marriage will not work and looking for a mutual consent divorce. However worried it may take too much of time? Can we go for Nullifying the marriage as both are worried about family reputation in village?

Since your marriage was solemnized in April 2023 only then you need to wait till 2024 as according to law no petition for divorce can be entertained by the court before the period of one year. But you can always go for judicial separation after which you will not be legally bound to live with each other. For more legal assistance I am just a call away.

You both can go for a mutual consent Divorce under section Section 13 (B) of the Hindu Marriage Act. It will take maximum of 6 months time for the court to grant the decree of dissolution. However this 6 months period can also be reduced and waived off in exceptional circumstances. You may connect

Rajesh ji, the marriage can be nullified only on the grounds mentioned under Section 10 and 11 of the Hindu Marriage Act as I believe you are a Hindu. Either of you should be of unsound mind or have a child outside of your marriage or is impotent, if not the marriage can't be nullified. For mutual divorce you must wait for 1 year from the date of marriage and will have to show that you are residing separately for at least 1 year to present the petition for mutual divorce. The marriage can be nullifying under some conditions as per law. In your case if any of that condition prevailing, we can move before the concern court for the process. otherwise you have to wait for 1 year from your marriage date for mutual consent divorce

Nullity of marriage can be done based on certain grounds otherwise divorce on mutual consent can be taken.

petition for mutual divorce can be filed only after staying apart for a period of one year.
