Seeking Legal Guidance on Marital Concerns and Phone Record Access

22-Apr-2026 (In Divorce Law)
I am facing ongoing issues in my marriage causing mental stress and confusion. There is a lack of emotional connection and transparency, bad behavior with outsiders etc. She avoids discussions and dismisses concerns. Additionally, she hides her phone and calls it personal privacy. I seek legal advice on my options and whether it is possible to obtain her CDR, including without her knowledge and related legal risks.

For getting CDR you need the help of telecom operators and they will not give you without the order of Court. So you may properly apply to Court along with your main petition ( like separation / divorce /RCR etc). Without the knowledge of your spouce it is illegal and impossible to get CDR. For more details you may contact me.

You can file application before the family court for divorce and in that petition during the pendency of the petition you can file application to obtain the CDR of the of your wife you can also obtain those documents with legal sanction and verify the same with the permission of the court normally this CDR and other related matters It's not important in the litigation

The facts stated, including lack of emotional connection, avoidance of communication, and conduct causing mental stress, may, if proved, constitute mental cruelty under matrimonial law, entitling you to seek appropriate reliefs such as divorce or judicial separation. Mere suspicion regarding interaction with third parties or personal conduct, however, requires clear evidence before it can be relied upon in legal proceedings. As regards Call Detail Records (CDR), the same cannot be obtained by a private individual without due process of law. Such records can be accessed only through lawful authority, and any attempt to procure them without authorization may expose you to legal consequences. In the circumstances, a detailed assessment of facts, background, and available evidence is necessary before proceeding further. You are advised to visit my office for a confidential consultation, so that an appropriate and effective legal strategy can be formulated

Right to privacy is a fundamental right. Unless there is any crime or Court decision, you cannot obtain the call details legally. other efforts to obtain such records are not legal. you can lodge a petition before the family court
