you can file a suit for recovery of money. you can attach the property of defendants before the judgement. you have to pay one tenth of the suit amount as court fee. it will be ordered as costs to you in case you succeed in the suit.

Q: Can I execute session court judgement in money and gold recovey

Can I execute session court judgement in money and gold recovey even when my high court appeal case is pending. It's been 8 years the respondents haven't paid any money or gold. My lawyer starts doing work for the execution of session court judgement. My high court is pending didn't goes much steps. Only notice send to the respondents and pending since 2025.

If there is no stay operation of judgement / decree, you can proceed with the execution. normally if the matter is pending at high court, sialkot's will be hesitant to proceed. however if there is no stay you can pray for proceeding the matter. Or file early posting petition in High Court and try for an early disposal.

Q: Defendant1 not filing reply to Summons even after 8 months

There are six defendants in total in my case filed at Munsiff court Alathur, Kerala. All defendants except one are represented by an advocate . One defendant is refusing to accept court summons. Court records show Defendat 1 received Summons in Aug 2025 . He has not filed REPLY till now even after 7-8 months. Is there a time limit within which a defendant has to file a reply to the court on receiving summons? I heard it was 3 months but is it being enforced by the court?

If they have not filed w s, after all opportunities court will set them exparte. Usually if the delay is brought to the notice of court, will set them exparte. even there after they can file petition to satisfied the exparte order

i have a property in perumbalam with a house of 300sqft. That building is around 40+ years old. And the walls are very weak.So i would like to know the deatils for either reconstruction or renovation for the same.

you can renovate the same existing square feet after taking prior approval from the local body and kczma. if you renovate or reconstruct it without obtaining prior approval regularisation may be in trouble. if you are a local inhabitant construction is permissible even in NDZ area subject to regulations

file a petition for return of money and ornaments before the family court. you can also approach the magistrate court under the provisions of protection of women from domestic violence act and seek an order restraining the respondent from selling the ornaments.
