Seeking divorce from foreign citizen of Indian origin, contested

08-May-2023 (In Divorce Law)
I am a (Hindu) Indian citizen and my husband is a foreign citizen of Indian origin. I was married to him 5 years back and have been emotionally, physically and financially abused by him and his family since then. I suffered from depression, anxiety and other physical health problems because of his and his family's treatment towards me. His family has confiscated all my jewellery and he had forced me to sell of the property I possessed. Because of the trauma I have not been able to work or study since last 5 years. I have been living apart from him since last 9 months in India. I wish to divorce him but he is not agreeing and wants to reconcile. He has been dishonest and disrespectful throughout the span of marriage. He is insecure and possessive in nature and had his family spy on me while I was waiting for my Visa and was staying at my parents' house with 5 other people. Pls suggest the process of moving forward with this divorce.

You can file a divorce proceeding against him on the ground of cruelty . In addition to that you can file a domestic violence petition before the concerned MM for claiming the maintenance and jewellery articles. in addition to that you can file a complaint in the woman cell under 498 A against your husband and in laws.

hello mam as i can read tht you have faceing the truma of of seized life along with marriage . in present situation in which you are standing is really a very bad situation . as you are saying tht you have been spied by a spy appointed by your husband. as you said your husband is not an indian citizen directly but he is a forigen citizen of indian origin . now you want divorce from your husband in present conditions is can be done . it need to be done with in ambid of the juridiction of the court . as well as the truna which you have faced in my view you should also file the dowery case maintinance case as well as you should also file the case of 406 ipc also along with dicorce case. along with divorce they should realise there mistakes and also pay you what everbthey have kept with them which belongsbto you as well as what ever you have sell becaus eof these people till now.
