Seeking divorce for unconsummated marriage

06-Mar-2023 (In Divorce Law)
I have been married for 5+ years. The marriage remains unconsummated because of my husband. I have not been able to know the cause as he refused to seek medical help. We went through psychological counseling for a year but the situation remains same as before. What are my options for divorce, both in terms of mutual and if only I file for it as he remains reluctant to give me divorce? We also have a house on joint mortgage.

You could have two forms of divorce as per law.
Mutual and contested.
Mutual is where both and you and your husband agree on its terms and conditions and file a joint petition.
Contested is where either party is reluctant to give a divorce, both parties defend each other’s claims and allegations.

I could assist you on the legalities that entail in this, do get in touch.

if he is not agreeing for mutual consent divorce better you file a case for divorce on ground of cruelty, non consumption of marriage and avoiding to take medicine help and avoiding to have sex for such long time definitely amounts to mental cruelty which is a very good ground for obtaining divorce as it is already held in many decisions of high court and supreme court.
