Seeking divorce for my sister who s sufferin frm kind of schizophrenia

25-Apr-2023 (In Divorce Law)
My sister got married before three years ago. She was suffering from mental issues and we’ve clearly explained about her illness before marriage. They were okay and accepted wholeheartedly. She has given birth to a baby boy after marriage. Once immediately my sister reached home from hospital after delivering baby, the scenes completely changed. They completely stopped caring about my sister. They never spent a paise and they never cooperated for her treatment. From Collecting all the stridan properties to till the first birthday of baby, he separated her baby. I’ve lot to say here. But can’t do due to the text limitation. Ultimately we decided to divorce him and we don’t his baby. Please guide me how we can get a divorce.

Your sister can file for divorce under suitable grounds before the court. Depending on the extent of the mental illness of your sister she will be able to file for divorce directly or through guardian. If the husband of your sister consents then your sister can opt for divorce by mutual consent.

Hi sorry to hear about your sister's problem. You can file for divorce before a competent court and ask for divorce. Approach a good civil advocate near you. There are many legal aspects to look in to while drafting the petition itself. Hope this can help you
