Secret Mutual Divorce in Bhubaneswar. Early Divorce in Bhubaneswar
26-Mar-2023 (In Divorce Law)
I had done Registry Court Marriage in Bhubaneswar. I was studying there at Bhubaneswar. The girl is from Bhubaneswar. I am from Cuttack. Now due to parents pressure, she is denying to marry me as per family problem. She wants to break down the marriage by mutual divorce. But she does not want that her family members should know about it. I am helpless. If there will be divorce then Court notice will go to her home and her parents will know about the court marriage. Can there be secret divorce I mean mutual divorce.
Divorce is divorce. There is no secret divorce whether it is a contested divorce or mutual divorce. The judgment which is pronounced is public and not secret.
You are from Cuttack and your wife is from Bhubaneswar. So you can file your Mutual Consent Divorce either before Family Court, Cuttack or Family Court, Bhubaneswar.
Your marriage was solemnised under the Special Marriage Act ( Court Marriage in your words ) for which you have to seek for Mutual Divorce under section 28 of the Special Marriage Act.
As far as your apprehension is concerned, note that, in mutual consent divorce, both the husband and wife apply for Mutual Divorce as the Petitioners. This is not contested divorce so that notice will be issued to the opposite party for appearance. The mutual divorce is completely in adverserial in nature and no notice is issued to either party. No notice is going to be sent to your home or your wife's home. Nor the knowledge or appearance of the family members are necessary. This is a matter between you and your wife and if you both have decided for Mutual Divorce then without wasting time file your case and remove the fear from your mind that parents will come to know about it.
Hope you got the answer.
