Retaining child custody.......

17-May-2023 (In Divorce Law)
My wife deserted me and living away last 15 months -300 kms away. No case. Son [adopted] 5.3 years old, is back living with me going thru studies [our matrimonial home, was out with wife for 1 year - last year]. Wife went and complained orally to PS that she wants me to bring kid back. I responded, can't do that and I am the primary legal custodian, due to corona/studies.. but she is planning to come /relatives to pick up the kid. How do I protect the kid ? also I want to get kid's name changed from his org. name by the biological parents? pls explain the process . thanks

You can give police complaint regarding this issue we should not provide to her child coustdy without court order without the court orders we can interfere with the court order that she want to file Guardian and wards act custody of the Chandan Indian Court Court order you won't get it

Mother is the primary lawful guardian of the minor child as per law. But you need not to hand over the kid and your wife has to go to court and file child custody case under Gurdian & Wards Act and through that she can get the custody of child and for you , you can ask child visitation right.
