Response to contested divorce notice
22-Apr-2025 (In Divorce Law)
My husband filed for contested divorce.I got notice and I did not attend first 2 hearings. Next hearing is in June. Now, I do not wish to contest and ok to mutually divorce. Should I hire an advocate to go through this or can my husband alone get it done through his advocate as he has already hired. What will be required from my side. Thanks.
You can inform him either directly or throw anyone or inform his advocate that you are okay for a divorce on mutual consent. you can also keep quite and wait for him getting a ex-parte order of divorce, if the ground that he has mentioned in his case / or allegation made against you is not bothering you .
Dear Madam,
It may be decreed ex-parte and they will be no adverse effect on you. Just take benefit of such ex-parte decree. Then you can apply and get certified copy of the same and proceed to go for second marriage if you are interested but you will not get alimony if you are not contesting.
It's better to file objection through lawyer and file for mutual divorce through advocate. If you do not file any objection and allow the petition to be allowed all baseless allegations made by him will stand and later you cannot claim for any other remedy. feel free to call for further guidance
