Yes, it is legally permissible for you to engage another advocate to file a contested divorce even if your DVC and maintenance cases were filed through a different lawyer. A client always has the right to change counsel at any stage of the proceedings. For filing a contested divorce petition, the original marriage certificate is not always mandatory. A certified copy or other supporting proof of marriage (such as wedding photographs, invitation card, or any available records) can also be relied upon if the original is already filed in another case before the court. Since your DVC and maintenance cases are already pending and still at the summons stage, filing a separate contested divorce petition on appropriate legal grounds such as cruelty or desertion is legally maintainable. Both proceedings can run independently. Your new advocate can obtain certified copies of necessary documents from the court record if required. Therefore, the absence of original documents should not prevent you from initiating divorce proceedings. Considering the delay and non-cooperation from the opposite party, it would be advisable to proceed with proper legal strategy and timely filing to avoid further prolongation of the dispute.
