The wife has got the right to stay in her matrimonial home and have residential rights in that. But the wife has to move to the court to claim this right. And if the wife is staying separately and is capable enough to maintain herself then she will not be entitled to any maintenance as well. For more legal assistance I am just a call away.

Wife has a right of residence however comes with certain restrictions when the matrimonial house is owned by in laws. If husband and wife are living separately from a significant period, and the wife is capable to maintaining her needs, then she might face difficulties to avail these rights. Yet, the courts have not marked any embargo against wife to claim any right as per law. Detailed discussion is needed for better advice. Feel free to contact Thanks

If both husband and wife staying separately then why would wife has rights over the property of in-law to stay ! Wife is entitled to claim right to residence in husband’s property. She would have been entitled is she would have been staying with in-laws since inception and her belongings are there too ! However in-law still have rights to evict her with due process of law
