Requesting for best advice on divorce contested

22-Mar-2023 (In Divorce Law)
How do I get decree of divorce faster? Can I remarry socially as I have already filed divorce? My wife wants to delay the process and that's why she doesn't appear in the court on date of hearing, what action can I take for this? My age is 40+ and thus responsibility is higher on taking care of my mother. What would come to my help to resolve the issue faster? I'm hindu by religion and married under special marriage act.

without getting the case details it is not proper to render any meaningful advice. be that as it may I would suggest you to get your case status vetted by an experienced lawyer who can either get the matter expedited by making appropriate application before the higher. court or even to the same court under relevant legal provision.

Without getting divorce from Court, you cannot remarry. To give opinion, it is necessary to know whether your wife has filed written statement opposing such divorce and whether the matter is in reconciliation phase. If you wish to take my Legal opinion professionally upon online payment, then can contact.

If it is contested Divorce, then the only procedure of getting divorce is through court and it takes time. Or else if you can convince the other party for mutual Divorce then it happens within 6 months. no you cannot remarry till the order of divorce given by the court. if your wife doesn't appear, then you can tell your advocate to go for ex parte hearing or issue show cause for causing unnecessary delay in the proceeding.
