03-Feb-2026 (In Divorce Law)
Hi, My brother got divored two years back from high court on the basis of cruelty. He got remarried after 3 months of his divorce decree and now has a one year child too. When his X wife got to know about his marriage , she filled SLP in SC against the divorce decree passed by high court . Hearing in SC is pending . What legal remedy can be used by my brother to protect his new marriage and small kid? Is it possible SC can reverse the divorce decree ar this stage after remarriage of

Hello, kindly state under what grounds the ex wife has filed the SLP. Additionally, if your brother has married after the divorce decree it is very unlikely that the SC will reverse the divorce judgment. However, to discuss in length kindly connect.

If divorce decree was valid and no stay was granted, remarriage after decree is lawful. SC generally won’t unsettle a concluded divorce after remarriage; at most relief may be compensatory, protecting second marriage and child.

Yes, you can remarry after 3 months, but only if: The 90-day appeal period is over, and No appeal has been filed by the other party in the High Court. Why this 3-month waiting period? Under Section 15 of the Hindu Marriage Act, the law gives both parties time to file an appeal against the divorce judgment. So marriage during this window is risky. Important caution ⚠️ If you remarry before 90 days and later your ex-spouse files an appeal, the second marriage can become legally problematic. Some courts have even treated such remarriages as invalid if an appeal was pending.

Yes, your brother can legally protect his second marriage and child Chances of SC reversing divorce at this stage are extremely low Worst-case scenario (very unlikely): financial compensation to ex-wife Disturbing the second marriage is practically off the table

your brother married after Akhil period so your brother's marriage and his child is not endangered legally but in law it is Android to appeal after delay also so his x wife firstly control the delay and afterward the Apple will started so your brother marriage is not endangered and mostly in supreme court also high courts judgement continue it's heavy possibility
