Related to child surname on birth certificate (when divorce is sure)

09-Nov-2023 (In Divorce Law)
I am on the verge of divorce, separated from my husband since 1 year. Child maintenance case is going, counselling took place but my husband is not interested to live together. I tried a lot to save this marriage but nothing is working. So I want to divorce my husband as soon as possible. Problem is birth certificate of my child. It has my husband's name and address. And my child owns his surname. I want to change all this. My child will be admitted in school next year and they will require birth certificate for admission. Also if I want to create any other official document of child, I need to submit birth certificate. So I want to change birth certificate of my child. Need to remove his father name, address and wants to give my surname to the child. So how it can be done? As of now divorce case is not filed by me, nor by my husband. I will go for mutual divorce, in case my husband agrees with alimony amount.

You can change the Name of your child after divorce that too with the consent of your husband. It can be changed if you remarry And step father adopts your child through An adoption deed And your ex gives consent to it. You May seek a detailed consultation for your legal issues
