Regarding transfer petition filed by my daughter in law after one year
26-Aug-2024 (In Divorce Law)
My son filed a case seeking for divorce ,since one year the case is going on. She attended the case alongwith her two advocates in Andamans. My daughter has also filed two cases 1.maintenance and conjugal in Trichy.Niw she has filed transfer petition in Supreme court and the now the divorce case is in stay.I need legal advice.
If the behaviour of your partner is intolerable towards and there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months.
if you need to defend the transfer petition, if you defend the transfer petition in the supreme court, the case will not be transferred , without contesting it will be easy for her to transfer, you need to take immediate steps towards defence, once you file counter claim her case will be dismissed
