If your husband has already filed for seeking access of your 10year old daughter then you may oppose his application stating all the facts and circumstances. Access means only the visitation rights or meeting her for a limited time. The Court may find it difficult to deny the Access to your husband he being the father of child but if the Court understands your daughter herself is getting mentally affected then Court can deny

Dear queriest if he was not in your and your daughters life since past 10 years then he has no right to claim your daughter's access, if he wants he can approach the honorable court for the same where we can defend against him regarding his absence in life of his daughter from her birth, for more information about the same kindly contact me.

Well, whether you grant him Divorce or not, if your Husband want to seek sole Permanent Custody of your children, then, he can apply for it. Whether, he will get the Custody or not is a secondary thing.

you can petition for divorce on Grounds of desertion as per section 13 hindu Marriage Act . you can also file application for maintenance of you as well as your daughter . moreover after taking into detailed concentration about negligions of your husband chances that the court may permanently handover the custody of your daughter to you only .
