Regarding maintenance money from husband

I Got married in 2011 .. I m 40 year old housewife and living separately with my 8 year old son since oct 2021 from my husband .. my husband told me if I file divorce he will not give maintenance money ..... And he said that according to law in India he have to pay a minimal ammount that will be insufficient for living ...please guide

Hello there, you can file case both for divorce and maintenance.. and your husband will be paying you maintenance.. the maintenance will be decided by the court look at the income and expenses of both the side. best wishes

दोनों पक्षों की आर्थिक स्थिति और बच्चे के ऊपर होने वाले खर्च के आधार पर माननीय न्यायालय खर्चा निर्धारित करता है कि कितना भरण पोषण होना चाहिए कि नहीं होना चाहिए उन सब पहलुओं को ध्यान में रखकर ही न्यायालय के द्वारा आदेश किया जाता है।

maintenance and divorce both are different issue. for maintenance it's court decide on ground of income and assets liability affidavit. and for divorce court decide on issues. if you want to get divorce then file contest. or also file a maintenance case.
