Regarding maintenance cost claim

We have separated on mutual consent . We have written letter on which we have written that we are getting separate on mutual consent and will not file any case or complaint on normal paper with signature of wife and her parents. So even though can she claim for maintenance cost in court ?

This is my response to you:
1. Your wife can always approach the court and file a case against you;
2. The laws are very much in favour of women;
3. A simple letter will not suffice, atleast make an MOU and notarize it;
4. Consult a local lawyer and take steps.

If you have got separated via written letter only then this seperaction is totally illegal. If you would have got separated by mutual consent divorce order then it was OK..
Your wife's maintenance right is still alive.
For your safeguard I would like to suggest file Mutual Consent Divorce Petition forthwith so you will not remain in such kind of maintenance and all kinds of tensions.
