Regarding interim maintenance order passed by family court

My wife filed sec 125crpc in 2017 and interim maintenance order was passed in 2019 mentioning to pay the maintenance from 2017. While passing the order no reason has been recorded in order copy. I want to know that from when I will have to Maintenance from 2017 or 2019

judge must have clearly mentioned in the interim order copy from when do u have to pay maintenance . if u can send me the copy I would be easily able to tell you .
mostly maintenance is granted from the time it has been asked .

under section 125 the maintenance may be awarded either from the date of the order or from the date of the application. section 125 crpc is the only statutory provision which provides the date from which maintenance is awarded.

Maintenance would be liable to be paid from the date of the filing of the application. So your maintenance liability starts from 2017. However if the amount seems to be irrational then you may file for a review or assail the same. For any further legal assistance please feel free to contact

If your application under 127 has been disposed off then you can always file a appeal for it in the sessions court. Then the session court will see into your matter and will decrease the amount if they are satisfied that you are not in the capacity to pay the said amount. hello client as i can see the issue is serious in your case execurion has been filled against the judgement of maintinance in this matter we can move for appeal of this matter of judgement it csn be possible tht we can get relief from high court.

Husband can only go to High Court to challenge this order by the way of revision petition. This is the only remedy available to husband …needed more facts on your case ….thanks a lot n take care of your health !

Yes…you can file for the cancellation of interim maintenance but you should have sufficient proof that either your wife is living in adultery or without sufficient cause is living separately. For more legal assistance I am just a call away.
