You can file a petition for maintenance under section 125 of CrPC in the local Court. The Court can order your husband to pay monthly child support. Immediately consult a lawyer to send a legal notice to your husband asking him to come to India for discussion or mediation. If your husband refuses to come to India for mediation, you can file for maintenance or divorce with your husband. The Court can summon him through the Embassy .

while this very difficult to keep up with needs of your child and also maintain yourself .stating the reasons for you to return to India is purely for the sake of your son and to take care of him we can file a case for maintenance for you and child which may also include a case for domestic violence because this amount to domestic violence and the same time your negligence by your husband will also be considered while granting maintenance and filling the domestic violen while understand that people of child health in such cases the grounds are very strong and we can see interim maintenance immediately.
