07-Jan-2023 (In Divorce Law)
Hi , I was facing lots of abuse in my inlaws house and I raised a police complaint in women's wing . Later called my parents and told what all abuse I m facing at my inlaws house. Later I started to my mom house in april for summer vacation . My husband raised a hcp case on me saying I eloped and ofcourse tht case got dismissed as it was purely family case and failed mediation. Now my husband is not intrested in having a family inspite he wants to take away kids from me. He is putting interm child custody. I have already send legal notice to come and have a family. He is willing to put kids I boarding school. Requested court interm petition tht he wants to put both kids in boarding school. And later putting for child custody. My twins r still 7 years old. Boy and girl were born in 2012. What should I do now. His and his parents motive is to grab kids from me and throw me on streets. I need to have kids with me.we r Hindus.
Dear Madam
Your sentiments will be understood by Court provided you take guidance of a. experienced advocate. There is nothing more than mother who always think of welfare of children. Children's welfare is main consideration for the courts. Put your case bonafidely and orfers in your favor. Your husbands intention is not bonafide.
Yes Madam, You have to contest the matter before the Court in G& WC case which is filed by your husband. You have to file Objections to the main petition. Rise appropriate objections about need of mother for kid who are the safe in the custody of mother. Show the financial capacity to maintain your child in health and education. Otherwise you have option to file CRL.Mis for maintenance case against your husband. File a case for restitution of conjugal rights. You are required personal consultation contact an advocate.
