recovery of streedhan from husband and mother-in-law

04-Jun-2025 (In Divorce Law)
is it necessary to file for a recovery suit against husband and in-laws to get streedhan back? all of my jewellery from both sides is lying in my mother-in-laws locker. They are obviously denying it but it includes jewellery gifted to me and my in-laws by my parents. I have an ongoing DV Case, FIR, Divorce (filed by him) and a Maintenance case under process. I can;t afford another case. Is there any chance that streedhan can be recovered under the already ongoing cases?

Would advise you to seek a detailed legal Consultation from an Advocate for your ongoing cases. Since your cases are ongoing you must be having a lawyer. Would advise You to seek a second opinion from some other experienced lawyer. No recovery suit need not be required. There are remedies which you can explore

Yes...the stridhan can be recovered under the FIR that you have registered against your husband and in-laws. When the chargesheet will be filed before the court it will include all the things that you have put in the marriage.

Yes you can absolutely recover streedhan from your husband and in laws by filing an appropriate application before the court where divorce and maintenance case is pending. However, there’s no other way and you don’t have to file another case to recover the same.

You don't need to file a separate recovery suit for getting back your streedhan. Streedhan can be recovered by filing an application in either of your cases or through police with the help of your lawyer. It's not a big task.

Yes, it can be recovered under your divorce case. just ask the presiding judge to allow amendment of plaint and add the request for streedhan. But to give you proper advice I would be requiring your plaint copy. Also, if you want creative advice to sustain your case or get money for a another case from your husband himself do contact me.
