I sent a legal notice to my wife since sep 2022 she was at her mother home and reply received from her you come to my home complaint she said i facing mental issues in marital home,and she said tell the date and time you come to mother home and pick me and girl baby 1 yr to return to marital home.then i filled RCR i want you to come back .after i filed a case in court RCR on first hearing she is not came shall i file a divorce case and get waiver for cooling period.and get divorce soon without maintenance she is already worked as a teacher m.com Hindu

In order to file divorce petition you need to withdraw the petition for restitution of conjugal rights first. If order is passed in rcr petition in your favour then you need to wait for a year to file divorce petition. Cooling off period is only for divorce by mutual consent.

from your statement you are in emergency to get divorce. as you think it will not be possible sooner period. the family issues could take a long time to resolve. the filing of rcr is just as procedure not for good caause
