Query Regarding RCR Orders and Filing for Divorce in Bangalore

My RCR case is at the Orders stage before the Family Court, Chennai. I also filed a Child Visitation petition. My wife filed a Maintenance petition but was absent for 6–7 hearings; the matter went ex-parte and was disposed in the last hearing. The Judge stated that RCR orders will be passed in the next hearing. My counsel advised filing for divorce in Bangalore after receiving the RCR order. I seek guidance on this.

Yes sir , you can file divorce case in Bangalore. The case is disposed in Chennai means you can file case here in Bangalore. Which case you filed in Chennai rcr or divorce case ? . But no problem you can file fresh petition in Bangalore family court .

Dear Sir, It sounds like you are navigating a complex transition between Family Court proceedings in Chennai and potential new litigation in Bangalore. Better withdraw RCR and file Divorce otherwise you have to wait for 0ne year under section 13 of HMA Act. Not to wait for RCR judgment. come to Bengalure with KYC details and file it Bengalure. Thus you will get divorce.

. Ground for Divorce: Non-Compliance with RCR Under Section 13(1A)(ii) of the Hindu Marriage Act, 1955, either party can file for divorce if there has been no restitution of conjugal rights for a period of one year or more after the passing of an RCR decree.  Waiting Period: You must wait for at least one year from the date the RCR decree is passed before you can file for divorce on this specific ground. Proof: You will need a certified copy of the RCR decree and evidence (such as your testimony) that cohabitation has not resumed during that year.  2. Filing in Bangalore (Jurisdiction) You can file for divorce in Bangalore if it meets any of the following jurisdictional criteria under Section 19 of the Hindu Marriage Act:  Current Residence: If you (the petitioner) reside in Bangalore and the respondent (your wife) is outside India or has not been heard from for seven years. Respondent's Residence: If your wife currently resides in Bangalore. Last Resided Together: If Bangalore was the last place you and your wife lived together as a couple. Marriage Location: If the marriage was solemnized in Bangalore.
