Query if i should do out of court settlement, or keep staying quiet

11-Jan-2023 (In Divorce Law)
My husband is working is an army officer. We have been married for 14 years. We have a 10 yr old daughter. due to our fights, i finally applied for grant of maintenance allowance from army. They say it will take almost 1 year for it to start. I have really given up. So asked husband if we can settle out of court and separate. He has agreed to give 5 lakh initially, and 60 lakh after 6 months.I wanted to ask whether this amount is ok for me, or should I ask more? His elder brother is in army, elder brother's wife is receiving pension, father is receiving pension. His mother has passed away. So he has no other to take care of except me and my daughter

If he has no other liability except for maintaining you and your daughter then the amount you have mentioned is average. But overall it’s you who has to judge upon your expenses. The education and the expenses of your daughter till she gets married must also be taken into consideration. For more legal assistance I am just a call away.

Hello, The decision of what the amount should be is very personal. What I would say is an amount of 65 Lakhs can fetch you approx 40k as interest per month if you keep it at Fixed Deposit. If you think with this 40k per month you can afford your lifestyle and education of your daughter, only then you may proceed ahead. For more information, feel free to have a word with me. All the best.

Greetings for the day! I would strongly advice that you must not have any oral settlement with your husband. Even any written settlement with your husband, will not come to your rescue, until it has been duly formulated by a person of some judicial standing. I would advice to go in for pre litigation mediation, if by and large your husband has agreed to your terms. The terms of settlement shall be enforceable in the court of law and will protect your legal rights. For further assistance, feel free to connect. Regards Nihaarika Jauhari

The amount for alimony is dependent upon your financial requirements, earning capacity and also your analysis of settling the matter. Based on the information given it is not possible to give an opinion and a fuller opinion will require detailed discussion.
