No, it is not required to send legal notice to her. And before filling divorce you can file sec 9 for restitution of congugal right in this suit husband can try to convince her wife to live with him and if husband won the suit and wife not want to resolve dispute with husband,. Then after we have reasonable grounds to file suit for DIVORCE & say in court she is not interested to settle their dispute, and deserted her matrimonial home without any reason, she is short temper, quarrelsome lady, and not want to live with you.
