No, it is not required to send legal notice to her. And before filling divorce you can file sec 9 for restitution of congugal right in this suit husband can try to convince her wife to live with him and if husband won the suit and wife not want to resolve dispute with husband,.Then after we have reasonable grounds to file suit for DIVORCE & say in court she is not interested to settle their dispute, and deserted her matrimonial home without any reason, she is short temper, quarrelsome lady, and not want to live with you. BUT in divorce it will take much time 4 to 5 YEAR to prove all that. If she and her parents is ready to to compromise on greed of money you can take mutatal divorce but give money in two or 3 installment because after taking money she can be changed her mind and not also liable to return money to you,. NOTE agreements should be written and all should be mention in that agreement after taking money she will give divorce all permanent alimony and strindhan have included in that agreement, if have any child custody who will take the custody of child

My marriage was held in Nov. 2020..I have filed FIR on my husband and in laws against dowry demand and domestic violence..MIL got bail and husband got interim bail..I have not received my stridhan or my stuff yet what to do ? You have asked many questions and all are pointwise as below:(1)498 is the suit for dowry demand against husband (2)DIVORCE is the case of husband and wife dispute and after living together, their dispute not resolved they can separate each other by and can take divorce(3)498 case will be take to 3 to 5 years(4)strindhan case initiate with 498 and in stiridhan when husband infringement of right of women to use her things that she brought from her home she can take it return from husband(5)if marriage was solemnization in nov 2020 you can not take divorce because for divorce is essential of minimum 1 year of marriage to file suit for divorce and if it is not mutual it will take more time
