Dear Sir, If it is in FIR stage it is advisable to file quashing petition. Further, apart from you other Accused are there then it is advisable to file quashing petition. If it is in trial stage that is hearing before charge after filing charge sheet normally the High Court may not entertain such quashing petitions. You may approach any Senior Advocate for drafting such quashing petition.
