Production of Income relate documents

I had moved an application against my husband to produce his bank statements and IT return copy to decide Interim maintenance in DV case. nWill court consider my request?nWhat is the general output, will court order my husband to submit all the documents?

Yes it is a well settled law that if you have moved application for maintenance he is bound by law to file his Affidavit of assets and liabilities if he did not do so the appropriate order will be passed against him for the same. for any further query kindly contact me.

Hello, As per judgement of Supreme Court Both the parties shall file an Affidavit for disclosure of Assets and liabilities before claiming maintenance. If any kind of misrepresentation is done then the wrongdoer will be held liable for the Contempt of the Court and the Court may consider the initiation of proceeding u/S. 340 of CrPC. Definitely he will have to submit the documents. In Domestic Violence cases, it is mandatory as a part of procedure for deciding interim maintenance for both the parties to submit their bank statements for the past 3 years and a statement of assets and liabilities to the Court.

somehow as you made application indirectly for prooving the court that your husband has quite more income from job/business that States the burden of proving the fact lies upon you. court will consider your application but until you don't specify the court with evidence that your husband has proper and stable income source court will not order your husband to submit the documents you asked for
