Process of filing mutual divorce, unregistered marriage

My sister's marriage is unregistered, she married within hindu customs, now she wants a divorce, no alimony required. Marriage in March 2024. It will be a mutual divorce. What's the procedure for this?

Do seek a detailed legal Consultation for your issue in hand. Mutual Consent Divorce petition can be section 13 B under the Hindu Marriage Act Do connect for the process and procedure to be followed for filing a Same.

We need more information in this regard ! Your sister though married this year in march 2024 as per Hindu rituals but Is your sister a Hindu or belong to other religion ? Kindly b in touch to understand the legalities in this regard Thanks

You need to approach the family court according to your jurisdiction and file a petition for the first mutual divorce and along with that you also need to file an application for waiver of the compulsory six months after which you will be able to get the divorce within a month.

You will have to wait till March 2025 and then can file for mutual divorce. Registration will not be a hindrance in filing for divorce. All we need is proof of marriage which can be marriage photos, marriage invitation card etc. please connect for discussion

Yes you can file mutual divorce petition before concerned court as per hindu marriage act. Some doxuments are to be required to get divorce by mutual consent that is Marriage photograph and card.
