Procedure to get divorce from uncaring husband

I from hindu. My husband doesn't look after my kids. Does not money. I want divorce from this man and save my children life.Im housewife. He does not care for us. How do I get divorce?

You have to live seperate from your husband minimum 6months before applying for divorce.then you have to be consult lawyer for filing petition.if you want you can claim momthly expenses from your husband.Since you have a child you have to fight with your husband for authority of child.

You can file divorce petition your Jurisdiction district court along with a petition of Pedialyte maintenance ,court first dispose your maintenance petition ,and for that you can maintain yourself including your child maintenance .

If your husband does not maintain you and your kid, then you can file a divorce petition before the Learned District Judge on the grounds of desertion and also file a subsequent petition before the Learned District Judge for maintenance.

Immediately file an application praying for maintenance under CrPC or under PWDV Act.
After that file an application for divorce under Hindu Marriage Act.
Consult an advocate and he shall guide you. Its a fit case and remedy is assured.

Hello,
You need to collect information (Evidence) regarding the earning of your husband, details of property in his name. On the basis of the same, the amount he has to pay can be decided easily by court for maintaining your children and you.
You have remedy under Section 498A, IPC, The Hindu Marriage Act, 195 and the Domestic Violence Act, 2005 and 125 CrPC. It completely depends upon your facts as which one will be applicable.
Regarding divorce, don't proceed immediately. First file for maintenance
