Procedure to get divorce from husband for torturing

I need a divorce from my husband... He leaves me from past 1n half year... I'm living with my mom... He sent a non judicial papers it's mentioned that he freedom me to his marriage life nd he Need my son.. I know as per law it's not valid for divorce..... Actually he mention in dat paper that he blames me... I had an affair with his absence but it's not true... He tortured me most... Nd he ditched me.after that he escaped from here to ka.. Now he return back to India so...i want to get a legal divorce from him so... I need a help now how to handle this suitation... Kindly requesting you please help
Dear Madam, First of all you have to police complaint against him, that he even legal we can file divorse also , regarding we need the detail histroy about the issue between the two persons to take forward in this matter.

Yes you can file a divorce against your husband. It is not clear regarding your religion. If you are a Hindu then you can file divorce under the Hindu Marriage Act against your husband for causing mental agony and as well seek alimony and maintenance during trial.
