Procedure to file for divorce in case wife left 2 years ago.
16-Dec-2023 (In Divorce Law)
Hi Sir, I am 35 years old hindu person from Kanpur. We are only a family of 3 persons with my mom and dad. I was married in 2014 June. After marriage we shifted to Mumbai where I work in a IT company. There were frequent quarrels in the house after marriage because of work stress and wife's angry nature. Wife also does not like my parents. She left me in 2015 June. I tried to call and sms her multiple times but she cancelled the tickets every time. She came for 10 days in Aug 2017 then left again. Wife's family also takes her side and they do not listen to me. I want to get out of this relationship. Please advise. Thanks
The husband has only few grounds for divorce. in your case it appears to be a ground of mental cruelty. since you have record of several messages and other details you can file divorce petition on these grounds. you can file your divorce petition at your place of residence/place where marriage was solemnised or the place where your wife resides. If you file in Mumbai your wife can file objection and application for transfer this case to her place of residence. It is quite difficult and time consuming for a husband to get divorce if the wife is not ready to divorce. The best way is to get divorce by mutual consent.
Sir you need to file a suit for judicial separation before the respected court and once the court give the order you do not need to co-habitat together and after or you can file for divorce your wife under sec-13A.
U can file divorce petition against her bcoz she deserted u without any reason and not performing her duty of being a wife which amounts to cruelty and mention other reasons also in ur divorce petition to prove ur case
