Procedure to file for divorce if husband is not living together

14-Dec-2023 (In Divorce Law)
I'm a Muslim, both are govt employees. Married in Jan'16. Soon after marriage, I've gone through physical, mental and financial abuse. When I'm unable to meet their demands for extra money, they prevented me from entering the house. I filed a complaint u/s498a. He came for compromise saying that we will start a new life. We composed in court. It's been 6 months. He went to another city for job. He's neither coming here, even on weekends nor allowing me to go there. He said he's not interested in living with me. When I asked for divorce as he don't want to live with me, he says he won't give divorce either.. What I can do in this regard? Please help..

You can seek appropriate relief under DVC Act, wherein you can seek not just maintenance but prevent from further abuse u/s,18,19,21. If you want to get separated, you can approach court for divorce under Muslim women protection act 1939 or if you want him to join you, you can issue notice for restitution of conjugal rights in order to make him join you or vice-versa.
