Procedure to apply for divorce after receiving notice
24-Nov-2023 (In Divorce Law)
My wife sended me a notice of mutual divorce after 2 years of our seperate. I want to b get divorce as soon as possible.. So that she & I can go forward in life without any problems in future . How much time can it take to get a divorce and how ??plz suggest me ..
Once a mutial divorce petition is filed, both paeties have to wait for six months. Which is mandatory. After six months both parties have to file individual affidavits and after filing affidavits, court will pass divorce orders.
For mutual divorce it takes normally 6 months waiting period. But, now it is not mandatory. In Sep 2017 Supreme court waived off this six months in certain circumstances which are file under Hindu Marriage Act, sec 13(B).
Sir you have to file a reply in the court for divorce and stating that you are willing to get separated mutually and your wife has also agreed for the same and if child is there then he will be with mother
Dear Sir,
You both need to file a joint petition for mutual consent divorce in the family court of jurisdiction where you both have last resided together or where your marriage was solemnized. After filing the petition and upon scrutiny of the same, the court will allot a case no for your divorce case and will give a date for your appearance (second motion) which will be after 6 months. On that date, you both need to appear before the court along with your respective chief affidavits and the court will examine you both and dissolve the marriage then itself.
