Prerequisites for Mutual Divorce
26-Feb-2023 (In Divorce Law)
Me & my husband have 2 contested divorce cases open respectively in different cities for last 3 years of separation. Now we both have agreed for filing mutual divorce. Is it an absolute mandatory to widthdraw the contested case before filing? Or can we file the joint mutual & then widthdraw the contested cases in the next earliest hearing, ofcourse before the final hearing date? Mrg. was under Special Marriage Act 1954.
there is no need to withdraw any case of contested divorce rather you can convert the contested divorce to mutual by courts order
There is no need to file a separate mutual divorce petition. Court will convert the existing petition to mutual consent divorce petition.
