Precautions if wife intent to commit suicide and mental torture

01-Oct-2023 (In Divorce Law)
My wife decided to leave me after just 7 months of our Hindu marriage – primarily because she doesn’t like my mom and hence wants me to leave my parents and live separately. I have summarily rejected her proposal. In those 7 months she has threatened to leave more than 15 times. Eventually she did so in July 2017. She is living with her parents now for the last 3 months. She is also pregnant with our first child. Before leaving me she had calmly expressed her intention of committing suicide. To save me from legal troubles, she made a video confession about her intent to commit suicide in future. She has also given me a copy of the suicide note addressed to her dad, to safeguard me against any future legal proceeding. I DO NOT wish to continue with this marriage. And I wish to keep Law in the loop as well by filing an FIR about her suicide confession. Divorce through mutual consent is less likely. Pls Advise. Thanks

Dear Sir,
First of all you have to decide your future with your family, wife and coming baby considering all relevant factor. Such decision cannot be taken under provocation etc. On the other hand you have right to file a case for restitution of conjugal right, Judicial separation and/or Divorce. if you have consent of your wife for divorce the matter would not be so complex. The waiting period of six months may be waive off by court.
Regarding your apprehension you may intimate the facts to the concerned Police Station and Women Commission.

In that case you have to file divorce under cruelty under section 13(1)(ia) of HMA. It is better if you go to police station and lodge a complaint with the copy of the video recording. It would make a good case for you to seek divorce.
