Please help me in my Divorce matter

I am hindu and railway servant. I have got married in feb 2015. I became father of a baby girl in march 2016. Me and my wife's relationalship didn't be fine after from three or four months of my marriage. So many times, she tried to tease me & my parents to call police, mahila aayog etc. but she failed to do it. Because police & mahila aayog read her mind and convinced her. But despite of it, her parents & some unknowing person guide her to do this type of act. She don't want to take divorce but she is not leaving a normal life, too. I don't want to break my relationship because i have a baby girl. But in this type situation, i am forced to break my relationship because (1) she don't want to do the household works (2) abusing every family member (3) call the police & mahila aayog any time. So, please guide what is the system of divorce and can i keep my baby with me ? And tell me the rules & expenses towards it.

Yes,you can file a petition to dissolve the marriage under section 13(1)(ia) of Hindu Marriage Act 1955 on the ground of mental cruelty by her,secondly you can file an application u/s 7 and 25 of the Guardians and wards Act 1890,and also section 6 of Hindu minority and Guardianship Act,1956 and expenses are nominal charges by the lawyers.

You can file case for divorce on the grounds of cruelty and submit all the documents to prove your ground.she may contest the case but you need to fight out strongly. Regarding custody of your daughter you can claim the same. You will get if not custody visitation rights being natural guardian and father. Sit with all elderly person of your family and her family and discuss all matter amd find out from her what she exactly wants. Just because you have a child does not mean to strach a relation . Talk and find out a mid way beacuse this prob can only be sought by talking. Also incase you thing she may impose false complaint against you and your family then give a written complaint in near police station regrdimg her mis behaviour and threats. This will save you in future
