Please advise about my martial issue

Hi sir my name is lakshmi Narayana from Rajahmundry. My wife ran away from me and married with another person 17 years ago. But I doesn't get any divorce from her. Is there any problem for me if I marry again. Please help me

have you gave any police complaint since last 17 years time ? in law terms if a person missing or not return with in 7 years are considered to be dead or missing in your case she left 17 years back so happily you can marry again.

Legally, you cannot remarry unless your first marriage is formally dissolved by a court decree of divorce. Even if your wife ran away 17 years ago and is living with another person, the first marriage is still valid in the eyes of law. However, based on your facts, you have strong legal grounds to obtain an ex-parte divorce on the grounds of desertion, cruelty, and adultery, because: ✔️ She abandoned you 17 years ago ✔️ She is living with another man ✔️ There is no marital relationship or communication You may file a divorce petition before the Family Court. The Court will issue notices; if she does not appear, the case can be decided ex-parte, and you will get a legally valid divorce decree. Only after that you can safely remarry without any criminal liability under Section 494 IPC (bigamy). Do not remarry until the divorce is granted. File the petition immediately for your legal protection.
