Permanent alimony or settlement in rcr or divorce case

19-Jul-2023 (In Divorce Law)
Hi. I am Tanya. I filed for rcr and my husband for divorce. Now it's almost at the end of the case. My lawyer says my rcr is of no use if I win as he is not ready to take me. We spoke for settlement but my husband is not ready to pay anything inspite being a central government employee. At this stage if I ask for permanent alimony through court what are the conditions and consequences? Please tell me if there is any other means of settlement in this matter.

Dear Madam, You may file application under Section 24 of HM Act and claim interim Maintenance and also try to amend your objections to Divorce case and claim alimony so that Court can give a finding on that. Even otherwise you can file 125 Cr.P.C for Maintenance. Be informed that in rarest of rare cases husband's divorce case will be allowed.

regarding above subject matter, yes correct if divorce case filed , you file permanent alimony, after judgement you can recover it, and also you can file interim mentenance application... both you can file, Permanent alimony is the amount taken only once for maintenance of the divorced wife whereas maintenance is the amount to be paid on monthly basis by the husband before, during and/or after getting the decree of divorce, further information please contact me
